Consumer Terms of Service

These Consumer Terms of Service (“Terms”) are a legal agreement between you and Gen Shipping Central LLC (“Gen Shipping Central,” “Model Me,” “we,” “our,” or “us”) and govern your access to and use of the consumer-facing parts of Model Me, including our website, application, consumer dashboard, approval flows, image upload tools, personalized art features, and related services (collectively, the “Service”).
By creating an account, signing in, uploading photos, approving or declining a business request, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service.
By using the Service, you represent and warrant that:
- you are at least 18 years old;
- you are legally able to enter into these Terms;
- the information you provide is accurate and current; and
- your use of the Service complies with applicable law.
2. Consumer Account
To use most features, you must create an account or sign in using a supported authentication method, such as Google OAuth.
You are responsible for:
- maintaining the confidentiality of your account;
- all activity that occurs under your account; and
- promptly notifying us of any unauthorized access or suspected security issue.
A single Google account may be used for both a consumer role and a business role where the Service allows it.
We may suspend or terminate your account if we reasonably believe you violated these Terms, created risk to others, or used the Service in a fraudulent, unlawful, or abusive way.
3. Your Profile and Photo Uploads
As part of onboarding or later use, you may provide profile information such as:
- display name;
- age range;
- gender;
- hair color;
- ethnicity;
- body type.
You may also upload photos of yourself.
You represent and warrant that:
- you own or control the rights needed to upload your photos and other content;
- your uploads do not violate any law or third-party rights;
- your uploads accurately relate to you and your intended use of the Service; and
- you will not upload unlawful, sexually exploitative, infringing, deceptive, abusive, or harmful content.
You remain responsible for the content you upload.
4. Permission Requests From Businesses
Model Me allows businesses to request access to your photo set and certain related profile details through approval links and other permission flows.
When you receive a request, you may:
- approve it;
- decline it; or
- sign in or create an account before responding, if required.
If you approve a request, you authorize the requesting business to access the data and content made available through that permission relationship, subject to the Service’s controls and these Terms.
If you decline, the business will not receive access through that request.
5. Your Control Over Business Access
You may use the Service to:
- view pending business requests;
- view businesses with active access;
- view revoked access history;
- revoke access from a business;
- add photos; and
- delete photos.
If you revoke a business’s access, that business’s access through the Service ends promptly.
If you delete photos, businesses with active access will only be able to access the then-current remaining photo set made available through the Service.
We do not guarantee deletion of copies that a business may have lawfully obtained before revocation or deletion, to the extent they were allowed to access them under the Service and applicable law.
6. Requests for More Photos
Businesses may send requests asking you to upload additional photos and may include a message or suggested photo types.
You are not required to respond. You may choose to:
- upload more photos;
- ignore the request; or
- decline the request.
7. Personalized Art Features
As part of the Service, Model Me may use your uploaded photos, profile data, prompts, and related inputs to generate personalized art, stylized images, or similar generated visual content for you (“Generated Content”).
By accepting these Terms and using the Service, you authorize us to use your uploaded content and related inputs to:
- process your requests;
- generate personalized art and similar outputs for you;
- display those results to you;
- store and manage those results as part of the Service; and
- support, secure, maintain, and improve that feature and the Service.
You understand that AI-generated outputs:
- may be imperfect, unexpected, stylized, or inaccurate;
- may not reflect real-world likeness with precision;
- may vary in quality based on image quality and model behavior; and
- may resemble outputs generated for other users.
We do not guarantee any specific result, style, likeness quality, or fitness for a particular purpose.
For clarity, your photos will not be shared with other businesses for personalized art generation unless you separately approve business access through the Service.
8. Rights in Your Content and Generated Content
Your Content
As between you and Model Me, you retain ownership of the photos, prompts, and other content you submit to the Service (“User Content”), subject to the rights you grant us in these Terms.
License You Grant Us
You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, modify, analyze, transmit, display, and use your User Content as necessary to:
- provide the Service;
- manage permissions and access controls;
- support photo storage and retrieval;
- generate personalized art and similar outputs for you;
- run quality checks and automated processing;
- maintain security and prevent abuse; and
- comply with law and enforce these Terms.
Generated Content
Subject to your compliance with these Terms, and except as limited by law or third-party provider terms, we assign to you any rights we may have in Generated Content created specifically for you through the Service. This does not transfer any rights in our platform, software, models, workflows, trademarks, or underlying technology.
9. Automated Processing
To operate the Service, we may automatically analyze uploaded images and profiles for things like:
- image quality;
- suitability;
- angle inference;
- consistency; and
- technical processing or flagging.
This automated processing helps us run the Service and may affect how features operate.
10. Prohibited Uses
You may not:
- use the Service for unlawful or fraudulent purposes;
- upload content you do not have rights to use;
- impersonate another person;
- attempt to access another user’s data without authorization;
- interfere with or disrupt the Service;
- reverse engineer, scrape, bypass, or circumvent security or permission controls;
- upload malware, harmful code, or abusive material; or
- use the Service to violate another person’s privacy, intellectual property, or other rights.
11. Deletion and Account Closure
You may delete your account through the Service where available.
When you delete your account, we may:
- permanently remove your photos from active storage;
- revoke business access;
- delete permission and photo-request records associated with your account;
- delete your consumer profile data; and
- delete the underlying authentication user where supported.
Some information may remain for a limited period in backups, logs, fraud prevention systems, dispute records, or where required by law.
12. Third-Party Services
The Service may rely on third-party providers, including authentication providers, cloud hosting providers, analytics tools, storage vendors, and AI model providers.
We are not responsible for third-party services, and your use of those services may also be subject to their terms and policies.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any generated content or business permission flow will meet your expectations.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEN SHIPPING CENTRAL LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- the amount you paid us, if any, in the 12 months before the event giving rise to the claim; or
- $100.
15. Indemnity
You agree to indemnify and hold harmless Gen Shipping Central LLC and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, losses, damages, liabilities, and expenses arising out of or related to:
- your User Content;
- your use of the Service;
- your violation of these Terms; or
- your violation of any law or third-party rights.
16. Termination
You may stop using the Service at any time.
We may suspend or terminate your access to the Service if:
- you violate these Terms;
- you misuse the Service;
- we reasonably believe your use creates risk, harm, or legal exposure; or
- we discontinue the Service.
17. Dispute Resolution
Please read this section carefully because it requires most disputes to be resolved by binding individual arbitration and includes a waiver of class actions and jury trials.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if it qualifies.
You and Gen Shipping Central LLC agree to waive any right to a jury trial and any right to participate in a class action, class arbitration, or other representative proceeding.
The arbitration will be conducted in San Francisco County, California, unless applicable law requires otherwise. The Federal Arbitration Act will govern the interpretation and enforcement of this section.
If any part of this arbitration section is found unenforceable as to a particular claim or remedy, then that claim or remedy will proceed in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction and venue for that limited purpose.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, except where federal law applies.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the “Last Updated” date. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
